In Three New Complaints, Emerald Lake Hills Ties Some Alleged Infringement Back to Amazon

On the heels of its March 2024 case against Amazon (Amazon Web Services), Emerald Lake Hills, L.L.C. (f/k/a Emerald Hills Consulting, L.L.C.) has sued Arista Networks (1:24-cv-00517), Cloudera (1:24-cv-00518), and Shopify (1:24-cv-00519), all four suits in the Western District of Texas. A single patent broadly directed to processing “discrete business activity management (DBAM) commands” is asserted in the complaints, with infringement allegations targeting the provision of defendant-specific products as well as of “products and services through Amazon Web Services (‘AWS’), including infringing products and services utilizing AWS architecture”.

Funded Hardin and Hill Campaign Picks Back Up with New Plaintiff

H2 Intellect LLC, an entity formed in Texas under the management of Ryan Hardin and Andrew Hill, has resumed the litigation campaign that had been proceeding with Hardin and Hill as individual plaintiffs. Three patents broadly directed to a content delivery platform for distributing programs based on the geographic location of a device are asserted in the new Eastern District of Texas complaint against IBM (2:24-cv-00367). H2 Intellect targets the support of geofencing technologies in various IBM products, including the IBM Streams, MaaS360, Max Engage with Watson, and Maximo Manage platforms.

Another New Mexico Plaintiff Appears to Skirt Certain Northern District of Illinois Local Rules

Following a pattern that has become familiar in early 2024, New Mexico plaintiff Navog LLC has launched litigation. A single patent generally related to a “GPS and warning system for an automobile” has been asserted in separate complaints targeting in-vehicle navigation and/or infotainment systems and filed against Panasonic (6:24-cv-00258) in the Western District of Texas; Rand McNally (RM Acquisition) (1:24-cv-04023) in the Northern District of Illinois; Trimble (1:24-cv-01378) in the District of Colorado; and Sygic (2:24-cv-00364), TomTom (2:24-cv-00365), and Verizon (2:24-cv-00366) in the Eastern District of Texas. Navog appears not to have complied with the local rules of the Northern District of Illinois in connection with the RM Acquisition case.

Delaware Plaintiff Asserts Memory Patents Against Cisco

Cisco (2:24-cv-00360) is the second defendant to be sued in the litigation campaign that Delaware plaintiff Innovations In Memory LLC (IIM) launched earlier this month with a suit against IBM. In the new Eastern District of Texas complaint, the plaintiff asserts three patents described as “concerning improvements in memory storage devices and systems”. Cisco is accused of infringement through the provision of a wide array of products, ranging from its “MDS 9000 Series Switches” to its “Unified Computing System”.

GeoSymm Ventures Files New Round of Suits over Patents Picked Up from Allied Security Trust

So far in May, GeoSymm Ventures LLC—an entity connected with a figure familiar in patent monetization circles—has added suits against ScienceSoft USA (2:24-cv-00338), Varjo Technologies (2:24-cv-00341), Walmart (2:24-cv-00342), and Zappar (2:24-in cv-00344), all in the Eastern District of Texas; Relinns Technologies (4:24-cv-01707) in the Southern District of Texas; and Trimble (1:24-cv-01274) in the District of Colorado. Relinns, ScienceSoft, and Walmart are each accused of infringing a single patent through the implementation of voice assistants in their respective products (i.e., chatbots and shopbots), while the remaining defendants are accused of infringing a different patent over products (e.g., headsets, mobile apps, and software) that support certain augmented reality (AR) functionalities.

Rothschild Plaintiff Hits Google in Wireless Charging Campaign

Following a revival of its sole litigation campaign with a suit against Samsung in February 2024, Electronic Edison Transmission Technologies, LLC—an entity associated with prolific inventor and frequent plaintiff Leigh M. Rothschild—has now sued Alphabet (Google) (2:24-cv-00335) in the Eastern District of Texas. Google is accused of infringing a single patent generally related to wirelessly transferring power from a “donor mobile device” to a “receptor mobile device” through the provision of various Pixel-series smartphones (e.g., the Pixel 5, Pixel 6, Pixel 7, Pixel 7 Pro, and Pixel 8). At issue is the Battery Share feature, which allows for reverse-charging other devices using the Qi wireless charging standard.

GoSecure Pegs CrowdStrike in West Texas

Cybersecurity firm GoSecure, Inc. has sued CrowdStrike (1:24-cv-00526) in the Western District of Texas, alleging infringement of two patents generally related to using identifying unauthorized activities on a computer system attached to a computer network. The plaintiff targets the provision of CrowdStrike’s endpoint security software, including its various Falcon-series products. Outlined in the complaint are purported past interactions between GoSecure and the CrowdStrike founders, with knowledge of the asserted patents alleged to reach back to their respective dates of issuance in August 2015 and April 2018.

Delaware Jury Awards IPA Technologies $242M in Trial over Former SRI International Patent

This past week, IPA Technologies Inc. successfully convinced a Delaware jury that Microsoft has infringed three claims from a single patent generally related to speech-based control over electronic resources through the provision of the Cortana digital assistant. The jury returned a verdict indicating that Microsoft failed to prove those claims anticipated by certain prior art (“the WARREN implementation of the RETSINA system”) and awarding $242M in damages. Meanwhile, district court litigation against Alphabet (Google) remains stayed to await IPA’s appeals from adverse final written decisions handed down in remand PTAB proceedings.

Embattled Damages Theory Lands Acceleration Bay a Jury Verdict in Delaware

A Delaware jury has returned a verdict in favor of Acceleration Bay, LLC and against Activision Blizzard, which Microsoft acquired last October. The jury awarded the plaintiff $23.4M in combined damages, $18M for infringement through provision of the defendant’s World of Warcraft video game; and $5.4M, through its Call of Duty. Two claims, one from each of two patents (surviving from an original complaint in which six patents were asserted), were tried to the jury in a case with a long, complicated history involving, among other things, multiple claim construction disputes over what it means for a gaming network to be “m-regular” and “complete” and a “just the facts” damages theory that apparently limped across the finish line.

AlmondNet Sues Amazon for a Third Time

AlmondNet, Inc.—this time with its subsidiary Datonics, LLC as a coplaintiff—has filed a third suit against Amazon (Amazon.com Services, Amazon Web Services) (6:24-cv-00234) in the Western District of Texas. The plaintiff asserts two patents broadly directed to using profiles of “Internet-using entities” to distribute targeted electronic advertisements, with Amazon again accused of infringement through the provision of its advertisement platform and services. At issue are features related to data collection and targeted advertisements.
